This website is operated by Rivironix, trading as DISTRIKT AUDIO. By accessing or using this website and the services offered, you agree to be bound by the following Terms and Conditions. If you do not agree to these terms, you may not use this website.

2. Scope

These Terms and Conditions apply to all visitors and users of the website as well as all orders placed through the DISTRIKT AUDIO online store. Consumers within the meaning of § 13 BGB and entrepreneurs within the meaning of § 14 BGB may use the store; mandatory consumer-protection provisions remain unaffected by these terms.

3. Use of the Website

  • The content of this website is provided for general informational purposes only and may be changed at any time without notice.

  • Use of the website is at your own risk.

  • You agree not to use the website in any unlawful or abusive manner.

  • Unauthorized use of the website may result in legal action.

4. Intellectual Property (Copyright)

All content on this website — including but not limited to design, layout, texts, graphics, and audio content and products — is the property of Rivironix / DISTRIKT AUDIO or its respective licensors and is protected by copyright law.

It is prohibited to:

  • reproduce or distribute content

  • use content for commercial purposes

  • share content without written permission

Exception:

  • You may download or print content for personal, non-commercial use.

  • Sharing with third parties is only permitted if DISTRIKT AUDIO is clearly credited as the source.

5. Disclaimer of Liability (Content)

DISTRIKT AUDIO does not guarantee the accuracy, completeness, or timeliness of the general informational content provided on this website. Use of such information is at your own risk.

This disclaimer does not affect your statutory rights as a consumer in respect of purchased products (see Section 12).

6. Website Availability

We strive to keep the website available at all times. However, uninterrupted availability cannot be guaranteed.

DISTRIKT AUDIO is not liable for:

  • temporary outages

  • technical disruptions

  • maintenance work

  • The inclusion of links does not imply endorsement.

8. Contract Formation (Purchases)

  • Product listings in the online store do not constitute a legally binding offer.

  • By placing an order, you make a binding offer to purchase.

  • A contract is only formed upon our confirmation, at the latest upon provision of the download or delivery of the product.

9. Prices and Payment

  • All prices are stated in euros and are final prices.

  • As the business is a small business under § 19 UStG, no value added tax (VAT) is charged or shown.

  • Payment is processed via the payment methods offered in the store (for example Shopify Payments / credit card, PayPal, and any other methods displayed at checkout). Payments may be handled by third-party payment service providers; the data required to process the payment is transmitted to the respective provider.

  • DISTRIKT AUDIO reserves the right to exclude certain payment methods.

10. Digital Products and Delivery

  • The products offered are digital products (e.g. audio files, presets, samples, downloads).

  • Delivery is made by providing a download or access link, generally immediately after successful payment.

  • It is your responsibility to ensure you have the technical means required to download and use the products.

11. Right of Withdrawal for Digital Content (Consumers)

Consumers generally have a statutory right of withdrawal. The detailed statutory cancellation policy (Widerrufsbelehrung) and the model withdrawal form are provided on our separate Withdrawal / Cancellation Policy page and form part of these terms.

Special rule for digital content: In the case of digital content not supplied on a tangible medium, the right of withdrawal expires before the end of the withdrawal period if you have expressly consented to the immediate commencement of performance and have confirmed your acknowledgement that, by giving your consent, you lose your right of withdrawal once performance has begun (§ 356 (5) BGB).

By completing your purchase of a digital product you give this express consent and acknowledgement, and you agree that download / access begins immediately.

12. Statutory Warranty Rights (Gewährleistung)

The statutory warranty rights apply to consumers without restriction. In particular, consumers are entitled to the statutory rights for defects under §§ 434 ff. BGB, including the statutory limitation periods. Nothing in these terms restricts or excludes these mandatory statutory rights.

13. Limitation of Liability

  • DISTRIKT AUDIO is liable without limitation for intent and gross negligence, and for injury to life, body, or health.

  • In the case of slight negligence, DISTRIKT AUDIO is liable only for the breach of an essential contractual obligation (an obligation whose fulfilment is necessary to properly perform the contract and on whose compliance the customer regularly relies), and in such cases liability is limited to the foreseeable damage typical for this type of contract.

  • Any further liability for slight negligence is excluded.

  • Mandatory statutory liability, in particular under the German Product Liability Act (Produkthaftungsgesetz) and the consumer warranty rights under Section 12, remains unaffected.

14. Governing Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with your habitual residence in another EU member state, the mandatory consumer-protection provisions of that state remain unaffected.

15. Dispute Resolution

The EU online dispute resolution (ODR) platform was discontinued by the European Commission on 20 July 2024 and is no longer available.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).

16. Customer Reviews and Verification

DISTRIKT AUDIO displays customer reviews and testimonials on this website. In accordance with § 5b (3) of the German Act Against Unfair Competition (UWG), we inform you as follows about whether and how we check that these reviews originate from consumers who have actually purchased or used the relevant products.

16.1 Origin of reviews. All reviews and testimonials shown on this website come from real customers who have purchased and used the relevant product. We do not publish fictitious, AI-generated, purchased, or incentivised reviews, and we do not alter the substance of a review.

16.2 How we verify reviews. Before marking a review as a "Verified buyer," we manually check that the review can be matched to a confirmed purchase order for the relevant product. This matching is carried out by comparing the reviewer's details (such as name and/or email address) against our order and payment records. Only reviews for which we hold such proof of purchase are labelled "Verified buyer."

16.3 Reviews without a verification badge. Some products sold by DISTRIKT AUDIO were previously offered for sale under a predecessor store operated by the same business. Reviews that were originally collected through that predecessor store relate to the identical product but cannot always be matched to a DISTRIKT AUDIO order. Such reviews are genuine and are published unaltered, but they are shown without the "Verified buyer" badge.

16.4 Display and ordering. Reviews are presented as submitted. We do not selectively display only positive reviews in order to create a misleading overall impression, and the order in which reviews are shown is not used to deceive consumers.

16.5 Material connections. Where a reviewer has any material connection to DISTRIKT AUDIO (for example, where a product was provided free of charge or in exchange for a review), this is clearly and conspicuously disclosed alongside the review.

16.6 Reporting concerns. If you believe a published review is inaccurate, misleading, or not genuine, please contact us at info@distriktaudio.com. We will investigate and, where appropriate, correct, label, or remove the review.

17. Changes to the Terms and Conditions

  • DISTRIKT AUDIO reserves the right to amend these Terms and Conditions at any time.

  • The current version will always be published on this website.

  • Changes do not apply retroactively to contracts already concluded.
